PROGRAM:

PRESIDENT ROB introduced Richard E. Mourdock, Indiana State Treasurer, who said his intended talk was entitled, "Economic Development in the State of Indiana". Since we had heard that news when TOM MORAN reported that support for the Gus Macker Tournament was not available, he wanted to explain the situation with the Chrysler bankruptcy and how it impacts Indiana pension funds. Holding secured bonds in Chrysler seemed a prudent decision when it was a good price and the state has many Chrysler employees. When bankruptcy was announced by the Federal Government secured creditors learned that they would receive 29 cents on the Dollar. Non-secured creditors were to get more than that. This violated 150 years of bankruptcy law under which "secured creditors should be paid in full". The State of Indiana argued in a suit that secured creditors have rights; that TARP (Troubled Assets Relief Fund) money was being used illegally; and there was a sub-rosa violation (must be fairness in evaluating assets). The Federal District court passed it along to the Supreme Court where Justice Ginsberg handled it. After an initial stay, the stay was lifted and the sale was completed. As a result of this situation, he predicts that many investments will be made internationally, where the rules have not changed. He also made the prediction that unemployment should peak at 11% in the 3rd quarter of 2010.
